Terms of Service
Please read these Terms of Service carefully before using the Ummah Eats mobile application. By creating an account or placing an order, you agree to be bound by these terms.
1. Acceptance of Terms
By downloading, installing, or using Ummah Eats, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the app. These terms constitute a legally binding agreement between you and Ummah Eats.
2. Service Description
Ummah Eats is a halal food delivery platform serving the Sacramento, CA metropolitan area. We connect customers with halal-certified restaurants and independent delivery drivers. Ummah Eats acts as a marketplace and technology platform — we are not a restaurant or food producer.
3. User Accounts
You must create an account to place orders. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Providing accurate and current information.
- Notifying us immediately of any unauthorized use of your account.
You must be at least 13 years old to use Ummah Eats. By registering, you represent that you meet this requirement.
4. Orders and Payments
All payments are processed securely by Stripe, Inc. By placing an order, you authorize us to charge your payment method for the total amount including food, delivery fee, and any applicable taxes.
- Prices are set by individual restaurants and may change without notice.
- Your order is not confirmed until the restaurant accepts it.
- You will receive a push notification confirming or rejecting your order.
- Payment is charged when you submit your order.
5. Cancellations and Refunds
You may cancel a pending order before the restaurant has accepted it. Once accepted, cancellations are subject to restaurant discretion. For refund requests due to incorrect, missing, or unsatisfactory items, contact us at support@ummaheats.co within 24 hours of delivery. Refunds are processed to the original payment method within 5–10 business days.
6. Halal Certification
Ummah Eats lists only restaurants that represent themselves as halal-certified. However, Ummah Eats does not independently verify halal certification. We make no warranty or guarantee regarding the halal status of any food item. Customers are encouraged to verify halal certification directly with the restaurant if this is important to them.
7. Driver Terms
Delivery drivers using Ummah Eats are independent contractors, not employees of Ummah Eats. As a driver, you agree to:
- Maintain a valid driver's license and vehicle insurance.
- Comply with all traffic laws and regulations.
- Deliver orders promptly and professionally.
- Not discriminate against any customer.
Ummah Eats is not responsible for driver conduct, vehicle accidents, or injuries during delivery.
8. Restaurant Terms
Restaurants listing on Ummah Eats agree to:
- Only list food items that are genuinely halal.
- Maintain accurate menus, pricing, and hours.
- Fulfill accepted orders in a timely and professional manner.
- Comply with all applicable health and food safety regulations.
Ummah Eats may suspend or remove restaurant listings at any time for violation of these terms or for poor customer experience.
9. Prohibited Conduct
You agree not to:
- Use the platform for any unlawful purpose.
- Place fraudulent orders or submit false refund claims.
- Harass, abuse, or harm other users, drivers, or restaurant staff.
- Attempt to reverse-engineer, hack, or disrupt the platform.
- Create multiple accounts to abuse promotions or features.
Violation of these terms may result in immediate account suspension.
10. Limitation of Liability
Ummah Eats provides this platform "as is" without warranty of any kind. To the maximum extent permitted by law, Ummah Eats shall not be liable for any indirect, incidental, or consequential damages arising from your use of the app, including but not limited to food quality issues, delivery delays, or loss of data. Our total liability to you shall not exceed the amount paid for the specific order giving rise to the claim.
11. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Sacramento County, California.
12. Changes to Terms
We may update these Terms from time to time. Continued use of the app after changes constitutes acceptance of the revised terms. We will notify you of material changes via push notification or email.
